On 9th April, 2015, appeal was listed under heading For Dismissal when no one appeared for appellant. 2 matter was again directed to be listed under heading For Dismissal with endorsement 3 . On 16th April, 2015, when appeal appeared with endorsement 3 under heading For Dismissal , Mr.Soumitra Mukherjee appeared and prayed for adjournment which was allowed. matter again appeared in list on 23rd April, 2015. Still no steps were taken to serve. On 23rd April, 2015, this court directed Mr. Mukherjee to give notice to advocate of respondent. Even that has not been done. Mr.Dutta appearing for appellant submitted that he has been engaged only yesterday and he has no instruction as regards service. This goes to show that appellant is not interested.
