Barooahs & Associates P. Ltd. Mr. R.K. Chowdhury, Advocate for appellant Court :- appeal was presented on 10th June, 2005 with application for condonation of delay of 84 days. After filing appeal Revenue became oblivious of matter. No steps whatsoever were taken either to have delay condoned or appeal admitted. On 22nd July, 2014 this Court directed matter to be listed for dismissal. On 9th September, 2014. Mr. Chowdhury prayed for leave to serve. This Court granted such leave. In spite thereof Revenue did not wake up. Again on 20th January, 2015 prayer for adjournment was made to carry out earlier order. Such prayer was also granted. Even that did not wake up Revenue. Today again matter has been listed For Order. Mr. Chowdhury repeated his prayer for adjournment. We are satisfied that Revenue is not interested in prosecuting appeal. 2 They are only interested to keep appeal alive and to keep agony of assessee continuing though long 10 years period has already passed. appeal is, therefore, dismissed.
