W.P.(C) No. 1830 of 2020 04. 13.02.2020 Heard. petitioner on receipt of summons vide Annexure-1 from Director General of Goods and Service Tax Intelligence (DGGI), Bhubaneswar Zonal Unit has filed his reply and matter is now pending in CGST. Mr. T. K. Satapathy, learned counsel for CGST submits that proceeding has been initiated on basis of Intelligence Report and some documents have been seized from petitioner for purpose of proceeding. In meantime, OGST has initiated proceeding under Section-70 of OGST Act vide Annexure-4. said proceeding is also pending. In proceeding before OGST Authority some documents have been called for from petitioner. grievance of petitioner is that, since documents called for by OGST Authority has been seized by CGST Authority, he is not in position to supply documents to OGST Authority. Mr. T. K. Satapathy, learned counsel for CGST submits that, though documents cannot be released in favour of petitioner in view of currency of proceeding, if petitioner applies for copy of same, copies can be supplied to petitioner in accordance with law. Regard being had to such facts, this writ petition is disposed of, directing petitioner to apply for copies of Documents required by him before CGST authority within 15 (fifteen) days from today. If such application is filed, copies of documents sought for shall be supplied within period of three weeks from date of his application. petitioner is directed to cooperate both CGST and OGST Authorities for early disposal of proceedings. writ petition is accordingly disposed of.
