|For Respondent(s) UPON hearing the counsel the Court made the following ORDER It has been brought to our notice that in the appeal against the quantum matter, the High Court of Judicature at Madras vide order dated 1st February, 2017 has partly allowed the appeal preferred by the appellant and remanded the matter to the Assessing Authority. The present special leave petition has been filed against an order declining to condone the delay of six Signature Not Verified Digitally signed by ANITA MALHOTRA Date: 2017.04.25 days in filing application for recalling of the ex-parte 16:26:01 IST Reason: order passed by the Income Tax Appellate Tribunal. 1 As the main appeal relating to the quantum has been remanded to the Assessing Authority, we feel that this petition has been rendered infructuous. The special leave petition is dismissed as having become infructuous.
