Bot Summary: Having heard Sri Nikhil Agrawal, learned counsel for the petitioner and Sri Ashok Kumar along with Ashish Agrawal, learned counsel for the Income Tax Department, we find that against the assessment order, the petitioner has filed an appeal along with a stay application before the First Appellate Authority in which 19.11.2015 has been fixed. Without going into the veracity of the assertion made by the petitioner, we dispose of the writ petition directing the First Appellate Authority to consider and decide the stay application of the petitioner on the date fixed i.e. 19.11.2015 after providing an opportunity of hearing and if for some reason the stay application could not be disposed of on that date, will ensure that the stay application would be disposed of within 10 days thereafter.
