The aforesaid position of filing of an application under the aforesaid provision is not disputed by Sri Alok Mathur, learned counsel for the appellant. He submits that this appeal can be adjourned awaiting any order passed on the said application. We are not inclined to keep this appeal pending in view of the fact that as and when orders are passed on the said application, it shall be open to the appellants to prefer an appeal accordingly against both the orders.
